ADATKEZELÉSI TÁJÉKOZTATÓ ÉS SZABÁLYZAT
- Az adatkezelési tájékoztató célja és hatálya
Adatkezelő az érintettek adatait jogszerűen és tisztességesen, az érintettek számára átláthatóan, az Európai Parlament és Tanács 2016/697. Rendelete (GDPR) rendelkezéseivel összhangban kezeli.
Az adatkezelés célja az https://www.outsider-hiking.com/ weboldalon kínált szolgáltatások és azokkal kapcsolatos tájékoztatás nyújtása, az adatkezelés ehhez szükséges mértékben és ideig történik.
Adatkezelő vállalja jelen szabályzatban rögzítettek betartását, érvényesíti az információs önrendelkezési jog és adatbiztonság követelményeit, megakadályozza az adatokhoz való jogosulatlan hozzáférést, és azok nyilvánosságra kerülését.
Adatkezelővel való kapcsolatfelvétel illetve az általa nyújtott szolgáltatások igénybevételének előfeltétele jelen Tájékoztató elfogadása. A Tájékoztató hatálya kiterjed a https://www.outsider-hiking.com/ weboldalon folytatott tevékenység során felmerülő valamennyi adatkezelésre.

- Fogalommeghatározások
Személyes adat: azonosított vagy azonosítható természetes személyre („érintett”) vonatkozó bármely információ; azonosítható az a természetes személy, aki közvetlen vagy közvetett módon, különösen valamely azonosító, például név, szám, helymeghatározó adat, online azonosító vagy a természetes személy testi, fiziológiai, genetikai, szellemi, gazdasági, kulturális vagy szociális azonosságára vonatkozó egy vagy több tényező alapján azonosítható.
Adatkezelés: a személyes adatokon vagy adatállományokon automatizált vagy nem automatizált módon végzett bármely művelet vagy műveletek összessége, így a gyűjtés, rögzítés, rendszerezés, tagolás, tárolás, átalakítás vagy megváltoztatás, lekérdezés, betekintés, felhasználás, közlés továbbítás, terjesztés vagy egyéb módon történő hozzáférhetővé tétel útján, összehangolás vagy összekapcsolás, korlátozás, törlés, illetve megsemmisítés.
Adatkezelő: az a természetes vagy jogi személy, közhatalmi szerv, ügynökség vagy bármely egyéb szerv, amely a személyes adatok kezelésének céljait és eszközeit önállóan vagy másokkal együtt meghatározza; ha az adatkezelés céljait és eszközeit az uniós vagy a tagállami jog határozza meg, az adatkezelőt vagy az adatkezelő kijelölésére vonatkozó különös szempontokat az uniós vagy a tagállami jog is meghatározhatja.
Harmadik fél: az a természetes vagy jogi személy, közhatalmi szerv, ügynökség vagy bármely egyéb szerv, amely nem azonos az érintettel, az adatkezelővel, az adatfeldolgozóval vagy azokkal a személyekkel, akik az adatkezelő vagy adatfeldolgozó közvetlen irányítása alatt a személyes adatok kezelésére felhatalmazást kaptak.
Az érintett hozzájárulása: az érintett akaratának önkéntes, konkrét és megfelelő tájékoztatáson alapuló és egyértelmű kinyilvánítása, amellyel az érintett nyilatkozat vagy a megerősítést félreérthetetlenül kifejező cselekedet útján jelzi, hogy beleegyezését adja az őt érintő személyes adatok kezeléséhez.
Adatvédelmi incidens: a biztonság olyan sérülése, amely a továbbított, tárolt vagy más módon kezelt személyes adatok véletlen vagy jogellenes megsemmisítését, elvesztését, megváltoztatását, jogosulatlan közlését vagy az azokhoz való jogosulatlan hozzáférést eredményezi.
- Jogszerű adatkezelés
Adatkezelő a pontatlan adatokat haladéktalanul törli vagy helyesbíti.
Adatkezelő az érintettek személyes adatait olyan formában tárolja, amely az érintettek azonosítását csak az adatkezelés céljának eléréséhez szükséges ideig teszi lehetővé, továbbá biztosítja a személyes adatok megfelelő biztonságát, beleértve az adatok jogosulatlan kezelésével szembeni védelmet.
Személyes adatok kezelésére az adatkezelőnél kizárólag az alábbi esetekben kerül sor:
- a) az érintett hozzájárulását adta személyes adatainak egy vagy több konkrét célból történő kezeléséhez;
- b) az adatkezelés olyan szerződés teljesítéséhez szükséges, amelyben az érintett az egyik fél, vagy az a szerződés megkötését megelőzően az érintett kérésére történő lépések megtételéhez szükséges;
- c) az adatkezelés az adatkezelőre vonatkozó jogi kötelezettség teljesítéséhez szükséges;
- d) az adatkezelés az érintett vagy egy másik természetes személy létfontosságú érdekeinek védelme miatt szükséges;
- e) az adatkezelés közérdekű vagy az adatkezelőre ruházott közhatalmi jogosítvány gyakorlásának keretében végzett feladat végrehajtásához szükséges.
Ha az adatkezelés hozzájáruláson alapul, az Adatkezelő bármikor igazolni tudja, hogy az érintett a személyes adatai kezeléséhez hozzájárult.
Az érintett jogosult arra, hogy a hozzájárulását bármikor visszavonja. A visszavonás nem érinti a visszavonást megelőző, hozzájáruláson alapuló adatkezelés jogszerűségét.
Adatkezelő ezúton is tájékoztatja az érintetteket, hogy a https://www.outsider-hiking.com/ weboldal cookie-kat használ.
Amennyiben az adatközlő nem a saját személyes adatait adja meg, úgy az adatközlő kötelessége az érintett hozzájárulásának beszerzése.
A Jelentkezést elküld gomb lenyomásával a megrendelőt fizetési kötelezettség terheli. A honlapon kezdeményezett megrendelés elektronikus úton megkötött szerződésnek minősül, amelyre az elektronikus kereskedelmi szolgáltatások, valamint az információs társadalommal összefüggő szolgáltatások egyes kérdéseiről szóló 2001. évi CVIII. törvény 5. és 6. §-ában foglaltak irányadóak. A szerződés a távollevők között kötött szerződésekről szóló 1999. (II.5.) Kormányrendelet hatálya alá tartozik.
- Az érintettek jogai
Helyesbítés
Az érintett kérésére az Adatkezelő indokolatlan késedelem nélkül helyesbíti a rá vonatkozó pontatlan személyes adatokat.
Törlés
Az érintett jogosult arra, hogy kérésére az adatkezelő indokolatlan késedelem nélkül törölje a rá vonatkozó személyes adatokat.
Az Adatkezelő az érintettre vonatkozó személyes adatokat indokolatlan késedelem nélkül törli:
- a) ha a személyes adatokra már nincs szükség abból a célból, amelyből azokat gyűjtötték vagy más módon kezelték;
- b) az érintett visszavonja a hozzájárulását, és az adatkezelésnek nincs más jogalapja;
- c) az érintett tiltakozik az adatkezelése ellen, és nincs elsőbbséget élvező jogszerű ok az adatkezelésre.
Tájékoztatás
Az érintett jogosult arra, hogy az adatkezelőtől visszajelzést kapjon arra vonatkozóan, hogy személyes adatainak kezelése folyamatban van-e, és amennyiben igen, úgy jogosult arra, hogy a személyes adatokhoz és a következő információkhoz hozzáférést kapjon:
- a) az adatkezelés céljai;
- b) az érintett személyes adatok kategóriái;
- c) azon címzettek vagy címzettek kategóriái, akikkel, illetve amelyekkel a személyes adatokat közölték vagy közölni fogják;
- d) a személyes adatok tárolásának tervezett időtartama, vagy ha ez nem lehetséges, ezen időtartam meghatározásának szempontjai;
- e) az érintett azon joga, hogy kérelmezheti az adatkezelőtől a rá vonatkozó személyes adatok helyesbítését, törlését vagy kezelésének korlátozását, és tiltakozhat az ilyen személyes adatok kezelése ellen;
- f) a valamely felügyeleti hatósághoz címzett panasz benyújtásának joga;
- g) ha az adatokat nem az érintettől gyűjtötték, a forrásukra vonatkozó minden elérhető információ.
Az Adatkezelő indokolatlan késedelem nélkül, de mindenféleképpen a kérelem beérkezésétől számított egy hónapon belül tájékoztatja az érintettet a fentiek szerinti kérelem nyomán hozott intézkedésekről vagy az intézkedés elmaradásainak okairól.
Korlátozás
Az érintett jogosult arra, hogy kérésére az Adatkezelő korlátozza az adatkezelést, ha az alábbiak valamelyike teljesül:
- a) az érintett vitatja a személyes adatok pontosságát;
- b) az adatkezelés jogellenes, és az érintett ellenzi az adatok törlését, és ehelyett kéri azok felhasználásának korlátozását;
- c) az adatkezelőnek már nincs szüksége a személyes adatokra adatkezelés céljából, de az érintett igényli azokat jogi igények érvényesítéséhez;
- d) az érintett tiltakozott az adatkezelés ellen.
Ha az adatkezelés korlátozás alá esik, az ilyen személyes adatokat a tárolás kivételével csak az érintett hozzájárulásával, vagy jogi igények érvényesítéséhez, vagy más természetes vagy jogi személy jogainak védelme érdekében, vagy az Unió, illetve valamely tagállam fontos közérdekéből lehet kezelni.
Az Adatkezelő minden olyan címzettet tájékoztat a helyesbítésről, törlésről vagy adatkezelés-korlátozásról, akivel, illetve amellyel a személyes adatot közölték, kivéve, ha ez lehetetlennek bizonyul, vagy aránytalanul nagy erőfeszítést igényel.
Adathordozhatóság
Az érintett jogosult arra, hogy a rá vonatkozó, Adatkezelő rendelkezésére bocsátott személyes adatokat tagolt, széles körben használt, géppel olvasható formátumban megkapja, továbbá jogosult arra, hogy ezeket az adatokat egy másik adatkezelőnek továbbítsa anélkül, hogy ezt akadályozná az Adatkezelő, amelynek a személyes adatokat a rendelkezésére bocsátotta, ha:
- a) az adatkezelés hozzájáruláson, vagy szerződésen alapul; és
- b) az adatkezelés automatizált módon történik.
Tiltakozás
Az érintett jogosult arra, hogy a saját helyzetével kapcsolatos okokból bármikor tiltakozzon személyes adatainak a kezelése ellen. Ebben az esetben az adatkezelő a személyes adatokat nem kezelheti tovább, kivéve, ha az adatkezelő bizonyítja, hogy az adatkezelést olyan kényszerítő erejű jogos okok indokolják, amelyek elsőbbséget élveznek az érintett érdekeivel, jogaival és szabadságaival szemben, vagy amelyek jogi igények érvényesítéséhez kapcsolódnak.
- Adatvédelmi incidens
Az adatvédelmi incidenst az adatkezelő indokolatlan késedelem nélkül, és ha lehetséges, legkésőbb 72 órával azután, hogy az adatvédelmi incidens a tudomására jutott, bejelenti illetékes felügyeleti hatóságnak, kivéve, ha az adatvédelmi incidens valószínűsíthetően nem jár kockázattal a természetes személyek jogaira és szabadságaira nézve.
VII. Jogszabályi háttér
Jelen Tájékoztató értelmezése során és a Tájékoztatóban nem részletezett kérdésekben az információs önrendelkezési jogról és az információszabadságról szóló 2011. évi CXII. törvény (Info. tv.), az Európai Parlament és a Tanács (EU) 2016/679 rendelete (2016. április 27.) a természetes személyeknek a személyes adatok kezelése tekintetében történő védelméről és az ilyen adatok szabad áramlásáról, valamint a 95/46/EK rendelet hatályon kívül helyezéséről (GDPR), az elektronikus kereskedelmi szolgáltatások, valamint az információs társadalommal összefüggő szolgáltatások egyes kérdéseiről 2001. évi CVIII. törvény (a továbbiakban: Eker. tv.) rendelkezései az irányadók.

PRIVACY NOTICE AND POLICY
1. Purpose and scope of this Privacy Notice
The Data Controller processes the personal data of data subjects lawfully, fairly and transparently, in accordance with Regulation (EU) 2016/697 of the European Parliament and of the Council (GDPR).
The purpose of processing is to provide the services offered on https://www.outsider-hiking.com/ and information relating to those services. Data are processed only to the extent and for the period necessary for that purpose.
The Data Controller undertakes to comply with this Policy, to enforce the requirements of informational self-determination and data security, and to prevent unauthorised access to and disclosure of personal data.
Acceptance of this Notice is a prerequisite for contacting the Data Controller or using its services. This Notice applies to all processing carried out in connection with activities on https://www.outsider-hiking.com/.
2. Details and contact information of the Data Controller
Data processing arising from activities carried out on https://www.outsider-hiking.com/ is performed by sole traders Kinga Balázs and Bence Kádár.

3. Definitions
Personal data: any information relating to an identified or identifiable natural person (“data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data or online identifier, or to one or more factors specific to that person’s physical, physiological, genetic, mental, economic, cultural or social identity.
Processing: any operation or set of operations performed on personal data or sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
Data Controller: the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of processing personal data. Where the purposes and means of processing are determined by European Union or Member State law, the controller or the specific criteria for its nomination may be provided for by European Union or Member State law.
Third party: a natural or legal person, public authority, agency or body other than the data subject, Data Controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.
Consent of the data subject: any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which the data subject, by a statement or clear affirmative action, signifies agreement to the processing of personal data relating to them.
Personal data breach: a breach of security leading to the accidental or unlawful destruction, loss, alteration or unauthorised disclosure of, or access to, personal data transmitted, stored or otherwise processed.
4. Lawful processing
The Data Controller shall erase or rectify inaccurate data without delay.
The Data Controller shall store personal data in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the data are processed, and shall ensure appropriate security of the personal data, including protection against unauthorised processing.
Personal data shall be processed by the Data Controller only in the following cases:
- the data subject has given consent to the processing of their personal data for one or more specific purposes;
- processing is necessary for the performance of a contract to which the data subject is a party or in order to take steps at the data subject’s request prior to entering into a contract;
- processing is necessary for compliance with a legal obligation to which the Data Controller is subject;
- processing is necessary in order to protect the vital interests of the data subject or another natural person;
- processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Data Controller.
Where processing is based on consent, the Data Controller shall be able to demonstrate at any time that the data subject consented to the processing of their personal data.
The data subject has the right to withdraw consent at any time. Withdrawal shall not affect the lawfulness of consent-based processing carried out before the withdrawal.
The Data Controller hereby informs data subjects that https://www.outsider-hiking.com/ uses cookies.
If the person providing data supplies personal data belonging to another person, that person is responsible for obtaining the data subject’s consent.
By pressing the “Submit application” button, the customer assumes a payment obligation. An order initiated through the website constitutes a contract concluded by electronic means and is governed by Sections 5 and 6 of Act CVIII of 2001 on certain issues of electronic commerce services and information-society services. The contract falls within the scope of Government Decree 1999 (II.5.) on contracts concluded between absent parties.
5. Rights of data subjects
Rectification
At the data subject’s request, the Data Controller shall rectify inaccurate personal data relating to the data subject without undue delay.
Erasure
The data subject has the right to obtain from the Data Controller the erasure of personal data relating to them without undue delay.
The Data Controller shall erase personal data relating to the data subject without undue delay where:
- the personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
- the data subject withdraws consent and there is no other legal ground for processing;
- the data subject objects to processing and there are no overriding legitimate grounds for processing.
Information and access
The data subject has the right to obtain confirmation from the Data Controller as to whether personal data relating to them are being processed and, where that is the case, access to the personal data and the following information:
- the purposes of processing;
- the categories of personal data concerned;
- the recipients or categories of recipients to whom the personal data have been or will be disclosed;
- where possible, the envisaged period for which the personal data will be stored, or, if this is not possible, the criteria used to determine that period;
- the right to request rectification or erasure of personal data, restriction of processing, or to object to processing;
- the right to lodge a complaint with a supervisory authority;
- where the data were not collected from the data subject, any available information regarding their source.
The Data Controller shall provide information on action taken on such a request without undue delay and in any event within one month of receipt of the request, or shall explain why no action was taken.
Restriction of processing
The data subject has the right to obtain restriction of processing where one of the following applies:
- the accuracy of the personal data is contested by the data subject;
- processing is unlawful and the data subject opposes erasure and requests restriction of use instead;
- the Data Controller no longer needs the personal data for processing purposes, but the data subject requires them for the establishment, exercise or defence of legal claims;
- the data subject has objected to processing.
Where processing has been restricted, such personal data shall, with the exception of storage, be processed only with the data subject’s consent, for the establishment, exercise or defence of legal claims, for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.
The Data Controller shall communicate any rectification or erasure of personal data or restriction of processing to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort.
Data portability
The data subject has the right to receive personal data relating to them, which they have provided to the Data Controller, in a structured, commonly used and machine-readable format, and has the right to transmit those data to another controller without hindrance from the Data Controller, where:
- processing is based on consent or on a contract; and
- processing is carried out by automated means.
Right to object
The data subject has the right to object, on grounds relating to their particular situation, at any time to processing of personal data relating to them. The Data Controller shall no longer process the personal data unless it demonstrates compelling legitimate grounds for processing which override the interests, rights and freedoms of the data subject, or grounds relating to the establishment, exercise or defence of legal claims.
6. Personal data breaches
The Data Controller shall notify a personal data breach to the competent supervisory authority without undue delay and, where feasible, not later than 72 hours after becoming aware of it, unless the breach is unlikely to result in a risk to the rights and freedoms of natural persons.
7. Legal background
This Notice shall be interpreted, and matters not detailed herein shall be governed, by Act CXII of 2011 on Informational Self-Determination and Freedom of Information (Info Act), Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (GDPR), and Act CVIII of 2001 on certain issues of electronic commerce services and information-society services (E-Commerce Act).

MANDATE AGREEMENT FOR LEADING MOUNTAINEERING AND HIKING TOURS AND PROVIDING RELATED ADVICE AND ORGANISATIONAL ASSISTANCE IN HUNGARY AND ABROAD
This Agreement is entered into by and between ………………, sole trader (details required for the conclusion of the Agreement), as Service Provider (hereinafter: “Service Provider”, “tour leader” or “mountain guide”), on the one part, and:

1. Procedure for concluding the Agreement
1.1
The Principal and the Service Provider agree that the provisions of this Agreement shall apply where a mandate relationship is established between them in connection with domestic or international programme opportunities. The Parties agree that the mandate agreement is concluded when the Principal submits an offer in accordance with Clause 1.2, the Service Provider confirms it, and the Principal pays the participation fee in accordance with Clause 4. The Service Provider publishes invitations and tour offers on www.outsider-hiking.com.
1.2
The conclusion of the Agreement begins with the Principal’s contractual offer, which may be made by applying through www.outsider-hiking.com in the manner described in the application and payment information, or in person. For applications submitted through the website, the Agreement is concluded if the Service Provider sends its confirmation (“Application confirmation”) and, within three working days thereafter, the Principal transfers or otherwise pays the participation fee specified in Clause 4 to the Service Provider. The Service Provider verifies the sending of its confirmation through its own system.
The mandate agreement is concluded when the participation fee—or, in the exception set out in Clause 4, the relevant portion of the participation fee—is paid within the above deadline and credited to the Service Provider’s bank account. By doing so, the Principal makes their contractual declaration and confirms that they know, understand and accept the contents of the mandate agreement, have carefully read the participation conditions, and expressly accept the Service Provider’s offer and the provisions of the Agreement.
Accordingly, the general terms and conditions contained in this document, the additional detailed rules in the application and payment information, the tour programme and the application form form inseparable parts of the mandate agreement. The Principal acknowledges and declares that they have read and understood their contents and expressly accept them as inseparable parts of the Agreement.
The Principal must provide true information on the application form. The Principal bears full responsibility for the truthfulness and accuracy of the information provided; the Service Provider shall not be liable for it. With regard to personal data provided on the application form, the Service Provider shall deem that the data were supplied by the person identified therein, and that the entry and disclosure of the data and the application for the tour occurred with that person’s express consent. Completion of the application declaration constitutes express consent to the Service Provider recording the personal data provided and retaining them in its customer-relations records.
Where the application is made through the Service Provider’s website, in order to expedite administration the Service Provider shall not print and send the mandate agreement, application and payment information, application form and tour programme by post, but shall send those documents to the email address supplied by the Principal on the application form. The Principal may nevertheless request paper copies by post, in which case the Service Provider shall dispatch them by post.
If the customer orders the service or enters into the Agreement for one or more third-party fellow participants as well, the customer is responsible for informing those persons. Until the tour begins, the rights and obligations of the Principal under the mandate agreement shall apply to the customer contracting for the third-party participants, except for obligations which by their nature can apply only personally to those participants, such as mandatory vaccination.
The Service Provider may validly communicate contractual declarations and fulfil its document-delivery obligations by sending them to the name, postal address, email address or other contact details supplied by the customer. The Service Provider is not required to verify the authenticity of the information or delivery address; the person completing the form is responsible for the truthfulness and lawful provision of the data. The customer must notify the Service Provider of any change to such data immediately, by a written declaration demonstrably received by the Service Provider no later than 15 days before the tour’s starting date. The Principal is responsible for failure or delay in giving notice in the prescribed manner. The Service Provider shall not be liable for a change notified within the above deadline which excludes or restricts the Service Provider’s ability to perform, and it shall not be obliged to perform the Agreement. Clause 5.1 shall apply in that case.
2. Performance of the mandate agreement
2.1
In view of its organisational competence, the Service Provider primarily and separately provides assistance relating to rest and recreation and, in connection with or separately from the foregoing, advice and information concerning mountaineering and other programmes; information necessary for the smooth and safe conduct of a tour; and assistance with room reservations, catering services, local programme organisation, tour-guide services and related administration that do not constitute a travel package.
In accordance with its online offer and the individual Agreement, the Service Provider undertakes to provide the technical equipment and aids relating to such programmes. Where the Service Provider supplies technical equipment for a tour as described in its online offer, the Principal is responsible for returning it complete and undamaged.
The Principal may use their own technical equipment if the Service Provider has inspected it in advance and found it suitable. The Principal nevertheless uses it at their own risk, because the equipment’s complete history cannot be established by visual inspection.
The programme participation fee remains unchanged where the Principal uses their own mountaineering equipment, unless the Parties agree otherwise in advance and record that agreement in writing.
2.2
The Parties acknowledge that, as the mandate fee, the Principal pays the mountain-guiding fee, the advisory fee, the rental fee for technical equipment listed in the programme announcement, and all costs incurred by the mountain guide in respect of accommodation, meals, lifts, permits and admission fees. Travel expenses shall be paid in accordance with an individual mutual agreement or the programme announcement.
2.3
The mandate fee does not include the Principal’s other expenses arising from entertainment, rest or recreation, such as accommodation, meals, local tour-guide fees and travel expenses. The Principal arranges such services directly, pays the relevant costs directly to the local service provider at the programme location, or otherwise provides for themselves in this respect.
2.4
The amounts displayed under “Tour costs” in tour programmes published on www.outsider-hiking.com are provided for information only and may change. The Service Provider cannot accept liability for changes or additions to costs payable at the location.
2.5
The Service Provider may terminate the mandate agreement with immediate effect if, through intentional or grossly negligent conduct, the Principal disrupts or endangers the peace, interests or physical safety of fellow participants or the conduct of the tour, or behaves in a manner that significantly hinders or makes it impossible to hike together, and fails to cease such conduct despite a warning from the Service Provider’s representative. In such a case, the Principal forfeits the mandate fee and must compensate the Service Provider for damage caused by the termination.
2.6
The Service Provider shall not be liable for damage suffered by the Principal as a result of circumstances outside the Service Provider’s sphere of control. This includes, in particular, cases where the Principal intentionally or seriously, or repeatedly despite warning, breaches the tour leader’s instructions; provides false information on the application form; conceals material information about their health; the tour leader changes the location, time or other conditions of the tour because of sudden and unforeseeable deterioration in the weather; the Principal does not appear, appears late, or arrives in a condition clearly unsuitable for the tour at the meeting place and time; or performance becomes impossible due to war, political tension or another event of force majeure.
The Parties regard these as circumstances for which the Service Provider is not responsible. In the latter case, the Service Provider may withdraw from or terminate the Agreement with immediate effect and shall have no liability for damages. The Parties regard this as termination of the Agreement for reasons outside the Service Provider’s responsibility.
2.7
The Principal must follow the tour leader’s instructions throughout the tour and must wear or carry the equipment prescribed by the tour leader. The Service Provider excludes liability for any damage resulting from breach of the tour leader’s instructions. In the event of an accident, the tour leader may be held liable only if non-compliance with safety rules can be proved.
3. Safety
3.1
The Principal must inform the Service Provider of all circumstances relevant to the subject matter of the Agreement, in particular any health condition that differs from the ordinary. The Principal must not suffer from an illness such as epilepsy, heart problems, asthma or diabetes which, as a result of above-average exertion or a possible stressful situation, may cause deterioration endangering the Principal’s life, physical integrity or health, thereby endangering not only their own health but also the safety of the group.
3.2
The Principal acknowledges that outdoor programmes, including mountaineering, are activities for which appropriate supplementary sports-accident insurance is essential. The participation fee does not include travel insurance or sports-accident insurance. The Principal undertakes to obtain such insurance and acknowledges that participation in the tour is permitted only with such insurance. If the Principal does not have valid sports-accident insurance for the entire duration of the tour, the Principal shall bear any loss or damage to their life, physical integrity, health or equipment.
3.3
Mountaineering, rock climbing, skiing and movement in an alpine environment are hazardous activities involving unpredictable hazards such as rockfall, storms and avalanches. The risk of injury or fatal accident cannot be completely excluded. A mountain guide substantially reduces that risk but cannot eliminate it entirely.
3.4
The Service Provider reserves the right to deviate from the programme published on the website or in the information document where justified. Justifying circumstances may include the inadequate health, fitness or technical competence of tour participants, or a change in tour conditions such as adverse weather or avalanche danger. The principal reason for such deviation is that the mountain guide assumes responsibility for the Principal’s safety.
3.5
For safety reasons, the number of clients on guided mountaineering tours is linked to a specified number of mountain guides. The stated value takes account of the internal guidelines and rules regulating the maximum number of clients in member countries of the International Association of Mountain Guides (UIAGM).
4. Payment terms
4.1
Upon applying, the Principal must pay the entire participation fee to the Service Provider in a single amount in accordance with Clause 1. An exception applies to programmes with a participation fee exceeding HUF 60,000, for which an application is made by paying 40% of the participation fee. The Principal must pay the remaining balance no later than 30 days before the tour programme’s starting date. Payment is deemed made on the date the fee or instalment is credited to the Service Provider’s bank account.
If the Principal does not settle the full participation fee by that date, this shall constitute termination of the Agreement by the Principal, in which case the Principal forfeits the amount already paid. For applications made within 30 days before the tour’s starting date, the Principal must pay the full participation fee at the time of applying, including for tours whose participation fee exceeds HUF 60,000.
If the Principal does not pay the contractual fee or instalment by the contractual deadline, the Service Provider reserves the right to call upon the Principal by email to pay the outstanding amount within an additional period of three days. The additional period begins on the day following the sending of the email by the Service Provider. The Principal may perform within that additional period. The Parties agree that granting the additional period does not change the original due date or deadline and does not constitute an amendment to the Agreement.
4.2
The Principal accepts that the Service Provider will send an electronic invoice for payment, attached to an email as a PDF file, to the email address provided by the Principal on the application form. The Service Provider reserves the right to issue a paper rather than an electronic invoice and deliver it by post or another method, including in person. The person identified as the Service Provider in the Agreement is responsible for issuing the invoice.
4.3
The Principal may transfer the right to participate under the mandate agreement to a third party who satisfies the conditions specified in the mandate agreement and required for participation in the tour. The Principal must inform the Service Provider of the transfer without delay and provide credible evidence of the transfer, including the details necessary to identify the transferee. The transferor and transferee shall be jointly and severally liable for contractual obligations arising before the transfer and for documented additional costs resulting from it. No fee is payable to the Service Provider for the transfer.
5. Cancellation, withdrawal and refunds
5.1
If the Principal cancels the service by written declaration or cannot use it for any reason within the Principal’s sphere of interest, the Principal must pay the following cancellation charge to the Service Provider:
- for cancellation or withdrawal between 60 and 21 days before departure: 40% of the participation fee;
- for cancellation or withdrawal between 20 and 11 days before departure: 70% of the participation fee;
- for cancellation or withdrawal within 10 days before departure, or failure to appear: 100% of the participation fee.
Failure to start the tour programme without a prior declaration also constitutes withdrawal. A cancellation declaration may be made only in writing and in a verifiable manner, for example by registered post, to the Service Provider identified in the Agreement.
5.2
Where cancellation occurs more than 61 days before the programme begins, the Principal must pay the Service Provider HUF 6,000 as reimbursement of expenses if the participation fee does not exceed HUF 60,000, or 10% of the participation fee if it exceeds HUF 60,000. Cancellation must also be made in accordance with Clause 5.1 in this case.
5.3
If the minimum advertised number of participants is not reached, the Service Provider must notify the Principal or Principals no later than 10 days before the programme’s starting date. In that case, the Principal may:
- request that the same tour operate with fewer participants at a higher participation fee;
- select another programme without application of the charges specified in Clause 5.1; or
- request immediate repayment of all instalments or participation fees paid for the tour.
In the last case, the Service Provider shall owe no compensation beyond repayment of the participation fee.
If the Principal fails to fulfil the obligation set out in Clause 4.1 by the applicable deadline, the Service Provider may, at its discretion and instead of applying the preceding provisions of this Agreement, withdraw from or terminate the Agreement with immediate effect, with the legal consequences set out in Clause 5.1.
5.4
If the mountain guide named in the programme announcement or Agreement is unable to lead the tour because of their health or another problem, the guide may appoint another mountain guide with equivalent qualifications. If no replacement can be found, the tour shall take place at a later date determined by the Service Provider. If that date is unsuitable for the Principal, the Service Provider must immediately repay all instalments and participation fees paid for the tour. In that case, the Service Provider shall owe no compensation beyond repayment of the participation fee.
5.5 Bad weather and force majeure
The Service Provider shall inform the Principal about weather conditions at the tour location at least one or two days before departure or travel. If the meteorological forecast is unfavourable for the area throughout the entire programme and may endanger participant safety to such an extent that the tour would probably be unable to start after arrival, the Principal may accept an alternative. This may take the form of a replacement programme or participation in the tour on a later, agreed date.
If the replacement programme or date is unsuitable for the Principal, the Service Provider must immediately repay the participation fee paid for the tour. The Service Provider shall owe no compensation beyond repayment of the participation fee, including for advance accommodation bookings or airline tickets.
The foregoing applies only where neither Party has yet travelled to the programme location. If the programme cannot take place because of bad weather after arrival, or if the tour has already started, Clauses 2 and 3 shall apply.
6. Other provisions
6.1
The Principal consents to the Service Provider publishing film, audio recordings or photographs made by the Service Provider and/or participants during the tour on www.outsider-hiking.com, Facebook and Instagram, and using them without restriction for other promotional purposes in the course of its business activities. This does not include publication of indecent recordings or recordings that violate human dignity.
6.2
Participants aged between 14 and 18 require the consent of a parent or guardian. For a minor under 14, the parent must also be the contracting party in addition to giving consent. A minor under 14 may participate only when accompanied by an adult.
6.3
For matters not provided for in this Agreement, the Parties agree that the relevant provisions of the Hungarian Civil Code shall apply.
6.4
The Principal assumes financial liability for any damage to or loss of equipment owned by the Service Provider and supplied free of charge or under a rental arrangement.
7. Settlement of disputes
The Parties shall primarily seek to resolve any unexpected dispute arising from this Agreement through consultation and amicable settlement. If this is unsuccessful, the Parties confer exclusive jurisdiction upon the court having territorial jurisdiction at the Service Provider’s registered office, subject to the rules on subject-matter jurisdiction in force at the relevant time.
